Judge quashes Kline's abortion claims

Within hours of Phill Kline's last attempt to intimidate Wichita-area doctor George Tiller, a state judge tossed out 30 misdemeanor charges.

Judge Paul Clark agreed to local district attorney Nola Foulston's request, finding that Kline had filed those indictments "without invitation, request or acquiescence of the duly elected and authorized District Attorney."

And so Phill Kline will end his term in office the way he always operated: violating the law to burnish his culture warrior credentials. Maybe Operation Rescue will name him Man of the Year next year also.

The charges were dismissed without prejudice, so Foulston or incoming AG Paul Morrison may file charges on the same evidence at a later date if it is deemed appropriate.

At the Johnson County District Attorney's Office Home Page, Phill Kline (the extra "l" is for loser) pimps a WingNutDaily column by local conspiracy theorist Jack Cashill (HT: KSDP Buffalo Blog). Kline's heading for the article is "WorldNetDaily coverage of Morrison / Tiller controversy," an…
Tiller didn't break law in reporting underage abortions: The Women's Health Care Services clinic in Wichita, operated by George Tiller, followed mandatory reporting laws for underage teenage sex in 15 abortions performed in 2003, Sedgwick County District Attorney Nola Foulston said today. The…
Having been demoted to a county district attorney in no small part because of his panty-sniffing obsession with patient records from family planning clinics, Kansas Attorney General Phill Kline has decided that one of his final official acts will be charging Dr. George Tiller with 30 misdemeanor…
Philll Kline to investigate AG Morrison's alleged improprieties. I must say that I don't see Kline's logic here. Morrison may well have done something wrong, and if so, his enemies' best move would be to sit back and let him fall apart on his own, and to force the Democratic governor to follow…

Phill (the second L is for "liar") Kline is about as nutso as they come.

The timing of his filing charges against Dr. Tiller was designed to catch the Sedgwick County (Wichita) District Attorney's office on the day before Christmas break. The AG's multi-page response (Kline's fall back position) was released minutes after the judge dismissed charges.

It's all preposterous political posturing on Kline's part. And even though the terminology as been marginalized, Kline's grandstanding seems like the "last throes" of radical evangelical Republicans. Kline's quick, though thoroughly legalistic response to the judge's dismissal, indicates they knew it was a fool's errand.

The right-wing Republican committee-people's selection of Kline to replace the very District Attorney who unseated Kline as Kansas' Attorney General are so hell-bent (heaven-bent?) to attack reproductive rights they'll resort to anything.

It's too bad Kline will not be charged with abuse of power and waste of taxpayer resources on a personal agenda.

The right thing was done in dismissing this fundy whackjob's phony charges.
The 'state' might want to talk to, oh, I dunno, a medical doctor. Even a layperson who does the research can figure out why.
Dr.Tiller is heroic. Kline's partner's - in - opinion have shot him and bombed his clinic, and he continues to provide a necessary medical service. The alternative to his clinic is deaths like that which occurred in Nicaragua recently to Jazmina Bojorge.

Babies are being killed just days before birth.

No, they aren't.

Ya gotta love it when Phill gets quashed.
