Within hours of Phill Kline's last attempt to intimidate Wichita-area doctor George Tiller, a state judge tossed out 30 misdemeanor charges.
Judge Paul Clark agreed to local district attorney Nola Foulston's request, finding that Kline had filed those indictments "without invitation, request or acquiescence of the duly elected and authorized District Attorney."
And so Phill Kline will end his term in office the way he always operated: violating the law to burnish his culture warrior credentials. Maybe Operation Rescue will name him Man of the Year next year also.
The charges were dismissed without prejudice, so Foulston or incoming AG Paul Morrison may file charges on the same evidence at a later date if it is deemed appropriate.

The timing of his filing charges against Dr. Tiller was designed to catch the Sedgwick County (Wichita) District Attorney's office on the day before Christmas break. The AG's multi-page response (Kline's fall back position) was released minutes after the judge dismissed charges.
It's all preposterous political posturing on Kline's part. And even though the terminology as been marginalized, Kline's grandstanding seems like the "last throes" of radical evangelical Republicans. Kline's quick, though thoroughly legalistic response to the judge's dismissal, indicates they knew it was a fool's errand.
The right-wing Republican committee-people's selection of Kline to replace the very District Attorney who unseated Kline as Kansas' Attorney General are so hell-bent (heaven-bent?) to attack reproductive rights they'll resort to anything.
It's too bad Kline will not be charged with abuse of power and waste of taxpayer resources on a personal agenda.

The 'state' might want to talk to, oh, I dunno, a medical doctor. Even a layperson who does the research can figure out why.
Dr.Tiller is heroic. Kline's partner's - in - opinion have shot him and bombed his clinic, and he continues to provide a necessary medical service. The alternative to his clinic is deaths like that which occurred in Nicaragua recently to Jazmina Bojorge.
