Earlier today, Secretary of Labor Thomas Perez announced that the Department of Labor has finalized a rule extending minimum-wage and overtime protections to home care workers. Starting on January 1, 2015, the wage and overtime provisions of the Fair Labor Standards Act will apply to home health aides, personal care aides, and other direct care workers employed by agencies. Back in December, the Department of Labor's Wage & Hour Division published a proposed rule that would extend minimum-wage and overtime pay protections to the home care workers who assist elderly and disabled patients with their daily needs. The Fair Labor Standards Act requires that nonexempt workers be paid minimum wage (currently $7.25 per hour) and 1.5 times their pay for hours worked above 40 hours in a week.
