Consistency Check

Let's do a little test, shall we? Let's see if all those folks who cry and whine about that big bad evil ACLU coming in and "intimidating" local school districts by filling lawsuits and then, when they win, getting the legal fees reimbursed will condemn such fee awards when they cut the other way. Here's an article about a situation in a Texas school district where the administration would not give equal access to a student Bible study group. A Christian legal group called Liberty Legal Institute filed suit on behalf of the student group and won the case (as they should have, both the statutory law and the judicial precedents are very clear on this issue). But here's the kicker:

The court ordered PISD to pay $100 in damages to SWAT and its founder and to pay the plaintiff's attorney fees. Sasser says the court "could not have been clearer" in its decision, and he is pleased with the outcome of the case, which is actually the second religious-freedom lawsuit filed against the Plano school district.

So let's hear from all of the people who claim that such awards should be outlawed. Where are our StopTheACLU friends? Steven Voigt, where are you? Michael Francisco, what say ye? Seth Cooper to the white courtesy phone. Anyone wanna bet we won't hear one word about those horrible legal groups stealing money from local school districts on this one?

Dave and Larry don't always perform together, of course. Larry has his own act, which can be seen at his blog pretty much every day. And he's continued to peddle nonsense on this issue over there. (1) The attorney fee awards that defendants must pay in establishment clause cases are often…
Good news from the 11th Circuit Court of Appeals that is hearing the appeal of the Cobb County evolution disclaimer case. The appeals court has refused to stay Judge Cooper's lower court ruling during the appeals process. Just like in the Terri Schiavo case, one of the key questions the courts…
Gribbit is proving to be the political equivalent of Old Faithful - every 8 minutes or so, you can be assured that he's going to spew some utter nonsense into the air. His latest concerns HR 2679, the bill that would eliminate legal fee reimbursement for establishment clause cases. In it, he…
Steven Voigt, writing at RenewAmerica, is complaining about the ACLU being able to collect legal fees when they win a suit against a government agency (you may remember Voigt from my earlier fisking of his terrible 14th amendment arguments). This is nothing new, of course; innumerable voices on the…

These people never listen. At the Crosswalk message boards I recently refuted the claim that the ALCU *always* takes the anti-Christian side in its lawsuits. When I presented direct evidence to the contrary, listing a number of occasions where the ACLU stepped in to defend the rights of Christians (after a two-minute Google), they ACLU-haters dismissed them as part of an ACLU ruse to obfuscate their true, Communist/Nazi/Satanic agenda.

...Communist/Nazi/Satanic agenda.

You of course mean the Nazi-Satanic-Atheistic-New Age-Secular Humanist, Homo-bortion-pot-and-commie-jizporium agenda.
